Terms of Use

These terms apply when you use the SHIFT Run Club website and member app, including creating an account, joining runs, posting content or using any community features.

By creating an account or using the service, you agree to these terms and our Community Guidelines. Please read them before getting involved.

1. About SHIFT

The service is operated by Taylor Seagrave trading as SHIFT Run Club, referred to in these terms as “SHIFT”, “we”, “us” or “our”.

2. Your account

You must provide accurate information when creating your account and keep it reasonably up to date.

Please keep your password and sign-in details secure. You are responsible for activity carried out through your account unless you tell us promptly that someone else may have accessed it.

You must be at least 18 years old to create an account.

You may not create an account for somebody else, impersonate another person or allow somebody else to use your account.

We may restrict, suspend or close an account where we reasonably believe that someone has:

  • broken these terms or our Community Guidelines;
  • behaved in a way that could endanger or seriously upset another member;
  • misused the website or app;
  • provided false or misleading information; or
  • created a security, safeguarding or legal risk.

Where appropriate, we will explain the reason and give you an opportunity to respond.

3. Taking part in SHIFT runs

Running and other physical activity involve inherent risks, including injury, illness, collisions, changing weather and uneven surfaces.

You are responsible for deciding whether a run is suitable for you and whether you are physically able to take part safely. Please consider the advertised distance, terrain, pace and weather before attending.

You must:

  • follow reasonable instructions from run leaders and event volunteers;
  • comply with the Highway Code and applicable local rules;
  • take reasonable care of yourself and others;
  • respect pedestrians, road users and other members of the public;
  • wear suitable clothing and footwear; and
  • tell a run leader about any immediate incident or safety concern.

You should not take part when unwell, injured or under the influence of alcohol or drugs in a way that could make participation unsafe. SHIFT does not provide medical advice, diagnosis or individual coaching unless we expressly state otherwise.

Nothing in these terms excludes or limits any responsibility that cannot legally be excluded, including responsibility for death or personal injury caused by our negligence.

4. Official and member-organised runs

An official SHIFT run is one advertised by SHIFT as an official club session and hosted by an authorised run leader or event team.

Members may also use the app to arrange informal runs with one another. These are personal arrangements between the members involved and are not organised, supervised, checked or endorsed by SHIFT unless we clearly say otherwise.

Anyone joining a member-organised run is responsible for assessing the route, other participants and whether the arrangement is suitable for them. Our separate Member-Led Run Disclaimer provides more information.

5. RSVPs and event places

An RSVP helps us understand expected attendance but does not always guarantee a place unless the event information expressly says it does.

For ticketed or capacity-limited events, additional booking, cancellation or refund conditions may apply. These will be displayed before you book.

Please cancel your RSVP or ticket when you can no longer attend so another runner can take the place.

We may need to change, postpone or cancel a run because of severe weather, unsafe conditions, low staffing, venue restrictions or circumstances outside our reasonable control. We will try to provide as much notice as reasonably possible.

6. Community behaviour

SHIFT should be a friendly and inclusive space. When using the service or attending a run, you must treat other members, volunteers, partners and members of the public with respect.

You must not use the service to:

  • threaten, bully, harass or discriminate against anyone;
  • organise dangerous, unlawful or deliberately misleading activities;
  • send spam or unsolicited commercial promotions;
  • collect or share another person’s information without permission;
  • interfere with the security or operation of the service;
  • upload malicious code or attempt to access another account; or
  • behave in a way that could reasonably damage the safety or reputation of the community.

7. Content posted by members

You continue to own the content you post, including photographs, comments, run requests and profile information.

By posting content, you give SHIFT a non-exclusive, worldwide and royalty-free permission to store, reproduce and display that content where reasonably necessary to operate, moderate and promote the relevant features of the service. This permission ends when the content is deleted, except where temporary backup copies remain or we need to retain evidence of a moderation or legal matter.

You must only upload content that you have the right to share. You must not post anything that:

  • is unlawful, threatening, discriminatory, abusive or seriously offensive;
  • contains somebody else’s private or personal information without permission;
  • infringes copyright, trade marks or other rights;
  • is deliberately false or misleading;
  • creates an unreasonable safety risk; or
  • advertises a business without our permission.

We may hide or remove content that breaks these rules. We may retain an internal record of moderation decisions where reasonably necessary for safety, complaints or legal purposes.

8. Photographs and event media

Photographs and videos may be taken at some official SHIFT runs and events.

Where practical, we will tell attendees when organised photography is taking place and explain how to let us know if they would prefer not to be photographed. Please also respect other members’ wishes when taking or sharing your own photographs.

9. Third-party services and links

The service may connect to or contain links to third-party services such as Strava, event-ticketing platforms, maps and partner websites.

These services are operated independently and have their own terms and privacy policies. SHIFT is not responsible for third-party services, content or availability, although this does not affect any legal responsibility we may have.

10. Availability of the service

The website and app are currently provided free of charge and on an “as available” basis.

We work to keep the service secure and functioning, but we cannot guarantee that it will always be available, uninterrupted or completely error-free. We may temporarily restrict access for maintenance, security or updates.

We may add, remove or change features over time. We will provide reasonable notice where a change significantly affects how members use the service.

11. Closing your account

You can delete your account through Settings or contact us at shiftrunclub@hotmail.com.

We may retain limited information after closure where reasonably necessary to comply with the law, resolve disputes, prevent misuse, maintain safety records or establish and defend legal claims. More information is provided in our Privacy Policy.

12. Our responsibility to you

We do not limit or exclude responsibility where doing so would be unlawful.

Subject to that, SHIFT is not responsible for losses that:

  • were not reasonably foreseeable when you agreed to these terms;
  • result from incorrect information you provide;
  • arise from an informal member-organised run;
  • result from your failure to follow safety guidance or reasonable instructions; or
  • relate to business, commercial or professional activities.

Your statutory rights are not affected.

13. Changes to these terms

We may update these terms when the service, our activities or applicable law changes.

The latest version will always be available through the website or app. We will give reasonable notice through the service or by email where changes materially affect members’ rights or responsibilities.

14. General terms

If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

A delay in enforcing these terms does not prevent us from enforcing them later.

These terms are between you and SHIFT. No other person has a right to enforce them.

These terms are governed by the laws of England and Wales. You may bring legal proceedings in the courts applicable to where you live within the United Kingdom.
